PHILADELPHIA — New video released shows a fight prior to a shooting that left a 23-year old man dead at Pat’s Steaks restaurant last week.
Police responded to Pat’s King of Steaks on July 22 at approximately 1am for a report of a person with a gun.
When officers arrived at the scene, they found 23-year-old David Padro of Camden, New Jersey, suffering from a gunshot wound to the lower back.
Officers rushed Padro to Jefferson University Hospital, but he was pronounced dead at 1:23am.
Witnesses told investigators Padro and a man, later identified as 36-year-old Paul Burkert of Reading, Pennsylvania, were in line for food when they got into an argument over a parking spot.
Burkert initially fled the scene following the shooting but later turned himself to police.
Investigators said Burkert is a convicted drug offender and was not allowed to have a gun, according to a report from NBC10 Philadelphia.
Charles Peruto, Burkert’s attorney, insisted that his client acted in self-defense.
“My client tried to throw a punch and then he was choked out to the point where he thought his head was gonna get ripped off,” Peruto told NBC 10. “Finally reached for his gun. Shot one time. Doesn’t even know where he hit him.”
Burkert was charged with murder, tampering with evidence, reckless endangering, conspiracy and weapon offenses.
